City of Harrison COUNCIL MINUTES
May 15, 2007


Council met in regular session with Mayor Daniel J. Gieringer. Members present included: Mrs. Deborah Acra, Mr. Tony Burkart, Mrs. Judy Kercheval, Mr. Joel McGuire, Mr. Bill Neyer, Mr. Jim Robertson, and Mr. Randy Shank. Mr. Bill Deters, the Law Director, was also in attendance.

The meeting opened at 7:30 p.m.

Mr. Shank made a motion, seconded by Mrs. Kercheval to approve the Council meeting minutes for May 1, 2007. The minutes were approved as presented.

Mr. Shank made a motion, seconded by Mrs. Kercheval to approve the Executive Session meeting
minutes for May 1, 2007. Those minutes were also approved as presented.

Mrs. Kercheval made a motion, seconded by Mrs. Acra to approve the purchase orders. Roll Call: All - yea.

Mr. Robertson made a motion, seconded by Mr. Shank to approve the April Finance Report. Roll Call: All - yea.

Police Chief Chuck Lindsey addressed Council to announce that Officer Scott Jenkins has been awarded the American Legion Officer of the Year Award by the local American Legion Post during Police Week. He also reported that all the Hamilton County award winners will be presented on Thursday at the Hamilton County Law Enforcement Appreciation Awards Dinner. At this time, Officer Scott Jenkins will be presented with the Hamilton County Act of Bravery Award for his efforts in saving a suicidal jumper on the I-74 overpass.

Chief Lindsey also announced that Officer Jeff Maurits has been awarded the Harrison Police Department's own Blue Knight Award for performing at the highest level 365 days a year. Officer Maurits is honored for his ability to recover property, to solve crimes, as well as enforcing the laws in the City of Harrison. Officer Maurits, a 15-year veteran of the department with prior service at the Sheriff's Office, has worked as a road officer in the uniformed patrol section as well as a detective.

Chief Lindsey presented the Blue Knight Award, which is a reproduction of an 1800's nightstick to Officer Maurits. Officer Maurits thanked the Chief and noted that his success is due to the leadership of Chief Lindsey and the team efforts of the entire department. Finally, Chief Lindsey announced that effective May 11, Detective Tim Snyder has medically retired from the Police Department. Detective Snyder has worked for the Harrison Police Department since 1994. The department will begin the process of hiring a new officer by contacting the Civil Service Commission for an eligibility list.

Mrs. Acra made a motion, seconded by Mr. Burkart to table the approval of an ordinance to increase the pay rate for part-time firefighter employees and the Medical Director's salary in the City of Harrison. Roll Call: All - yea.

Mrs. Acra made a motion, seconded by Mr. Robertson to enter into an executive session for the purpose of discussing details with regards to the part-time firefighter employees ordinance. Roll Call: All - yea.

Mayor Report

Mayor Gieringer read a proclamation establishing May 24 through May 26, 2007 as Poppy Days in the City of Harrison. The red poppy has been designated as a symbol of sacrifice of lives in all wars. The American Legion Auxiliary has pledged to remind Americans annually of this debt through the distribution of the memorial flower.

Mayor Gieringer read a correspondence from Claire Palmer of Community Services West thanking Council and the City of Harrison for their annual donation of $5,000 in helping local seniors.

The Mayor reported on the following receipts from the April Mayor's Court: City of Harrison - $7246; Treasurer of State - $1440; Drug Cases - $500; Computer Fund - $305; OVI Cases - $360 ; and Interest of March 2007 - $16.11. Mayor's Court receipts for April 2007 are down $3399 in comparison to 2006.

Mayor Gieringer reported that the City of Harrison received two awards at the Greater Hamilton Safety Council Awards Banquet. The city received the 2006 Best Non-Industrial Safety Record Award for under 250,000 "man hours" of work. This was accomplished for completing 240,000 "man hours" of work without a lost time accident. The second award was given by the Division of Safety and Hygiene.

Law Director Report

Mr. Deters had no report.

Council - Committee Report

Mr. Neyer reported that at the last Utility Committee meeting, members discussed ongoing projects within the city as well as the current status of the sewer line along Dry Fork Road. Mr. Neyer announced the next Utility Committee is scheduled for June 14 at 3:00 p.m. Mr. Neyer referred to a letter from Mr. Dan Brooks regarding the zoning on the Parks of Whitewater. In the letter Mr. Brooks explained the two methods used to calculate the density. The first method shows 3.18 units per acre based on 438.8 units on the 136-acre development. Mr. Neyer thanked Mr. Brooks for his explanation.

Mr. McGuire announced the Civil Defense Committee would meet on May 16 at 5:30 p.m. At this time the committee will review the first draft for the flood scenario tabletop drill. The drill is scheduled for August 15 at 9:00 a.m. Mr. McGuire announced the Street Committee would meet on June 14 at 4:00 p.m. He also noted that on June 8, OKI would hold a special meeting with US Trade Representative, Rob Portman.

Mr. McGuire congratulated Officer Jeff Maurits on receiving the Blue Knight Award. He also thanked Dan Brooks for clearing up the discrepancy with regards to units per acre on the Whitewater Parks development.

Mrs. Acra reported that Chief Lindsey, Lt. Wilson, and Clerk Chetwood attended a 6 hour class on House Bill 9 Public Record Law Changes. Officer Willig attended a 16 hour course on Water Related Death Investigations. Mrs. Acra announced the Police Committee meeting is scheduled for May 23 at 5:30 p.m.

Mrs. Acra announced the Buildings & Lands Committee would meet along with Harrison Township Representative on May 29 at the Community Center. At this time, an ad hoc committee has not been formed to discuss or approve of plans for a bike path. The city is also waiting approval from the Township Trustees on plans to move the Utility and Finance Departments to the North Conference Room at the Community Center.

Finally, Mrs. Acra announced that WESTJAD will meet on June 4 at 5:30 p.m.

Mrs. Kercheval announced the Economic Development / Resource Committee was originally scheduled to meet on Memorial Day, but will be rescheduled at a later date. Mrs. Kercheval reported that she will be meeting with local Economic Development directors over the next few weeks and will report her findings to the Mayor and committee members. Mrs. Kercheval reminded residents that the Southwest Local Relay for Life will be held on June 8 and 9 at the high school.

Finally, Mrs. Kercheval offered her congratulations of Officer Jeff Maurits.

Mr. Robertson announced the Finance Committee would meet on May 29 at 10:00 a.m. at the Community Center. Mr. Robertson reported the city received the first quarter check in the amount of $20,750 from Time/Warner for franchise fees.

Mr. Robertson reminded residents the Oldsmobile Car Club would hold a Car Show in historic downtown Harrison on Sunday, May 20.

Mr. Burkart reported on the following items from the May 9 Fire Committee meeting: The Medcount income from EMS billing through April is in the amount of $72,200. The monthly Fire Activity report was reviewed. The new squads are due within the next few weeks. The old squads will be sent to auction. Members of the Fire Department will receive new patches for their uniforms.

Mr. Burkart announced the Harrison Recreation Commission would meet on May 23 at 7:00 p.m.

Summerfun sign-ups will be held on May 26 from 12:00 to 3:00 and on May 29 from 6:00 to 8:00 p.m.

Finally, Mr. Burkart offered his congratulations to all the seniors who will be graduating this spring.

Mr. Neyer reminded Mr. Burkart that a parent needs to be present in order to register a child for the Summerfun program.

Mr. Shank announced the Personnel Committee would meet on May 23 at 6:30 p.m.

Mr. Shank offered his congratulations to the graduating seniors and Officers Jeff Maurits and Scott Jenkins on their accomplishments.

There being no further business, Council entered into an executive session.
